This website is operated by Notré Noir. Throughout the site, the terms “we,” “us,” and “our” refer to Notré Noir. Notré Noir provides this website, including all information, tools, and services available on this site, to you, the user, on the condition that you agree to all terms, provisions, policies, and notices stated here. By visiting our site and/or purchasing anything from us, you participate in our "Service" and agree to be bound by the following general terms and conditions ("Service Terms," "Terms"), including any additional terms and policies referenced herein and/or available via hyperlink. These Service Terms apply to all users of the site, including but not limited to users who browse, sellers, customers, vendors, and/or content contributors. Please read these Service Terms carefully before visiting or using our website. By accessing or using any part of the site, you agree to be bound by these Service Terms.

If you do not agree to all the terms of this agreement, you may not visit the website or use the services. If these Service Terms are considered an offer, acceptance is expressly limited to these Service Terms. All new features or tools added to the current store are also subject to the Service Terms. You can view the most recent version of the Service Terms at any time on this page. We reserve the right to update, modify, or replace any part of these Service Terms by posting updates and/or changes on our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform to sell our products and services to you.

Article 1 – Definitions
In these terms, the following definitions apply:

  • Cooling-off period: the period during which the consumer can exercise their right of withdrawal;

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Ongoing transaction: a distance contract concerning a series of products or services, where delivery and/or acceptance obligations are spread over time;

  • Durable medium: any means that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction;

  • Right of withdrawal: the ability for the consumer to cancel the distance contract within the cooling-off period;

  • Entrepreneur: the natural or legal person offering products and/or services remotely to consumers;

  • Distance contract: a contract concluded within a system organized by the entrepreneur for remote sales of products and/or services, using exclusively one or more means of remote communication;

  • Means of remote communication: a means used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same place;

  • General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order between the entrepreneur and consumer. Prior to concluding the distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where they can inspect the terms and conditions and they will be sent free of charge upon request. If the distance contract is concluded electronically, the terms and conditions can be provided electronically in a way that the consumer can store them on a durable medium. If specific product or service terms also apply, the consumer may rely on the provisions most favorable to them in case of conflict. If any provisions are void or annulled, the rest of the agreement remains in effect, and the invalid provision will be replaced in consultation to reflect the original intent. Situations not covered will be assessed according to the spirit of these terms. Ambiguities will be interpreted in line with this spirit.

Article 4 – The Offer
If an offer has a limited validity period or is conditional, this will be explicitly stated. The offer is non-binding. The entrepreneur may modify the offer. Offers include detailed descriptions of products/services sufficient for consumer assessment. Images are a truthful representation, but minor errors do not bind the entrepreneur. Each offer includes price (excluding import duties/VAT), shipping costs, payment, delivery methods, withdrawal rights, and any other relevant details.

Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions. If accepted electronically, the entrepreneur confirms receipt electronically. Appropriate technical and organizational measures ensure secure data transfer and web environment. The entrepreneur may verify the consumer’s ability to meet payment obligations. Information about the entrepreneur, withdrawal rights, guarantees, and other relevant details are provided with the product/service.

Article 6 – Right of Withdrawal
Consumers have 14 days to withdraw from a contract without giving reasons, starting the day after receiving the product. Products must be returned in original condition and packaging, with all accessories, following the entrepreneur’s instructions. Notification of withdrawal must be made in writing/email within 14 days, and the product returned within 14 days. Proof of timely return must be provided.

Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer. Refunds will be processed within 14 days of withdrawal, provided the product is returned or proof of return is provided.

Article 8 – Exclusion of Withdrawal Rights
The entrepreneur may exclude withdrawal rights for personalized, perishable, hygienic, or other items as specified, and for services started with consumer consent within the withdrawal period, or related to betting, accommodation, or leisure activities.

Article 9 – Price
Prices remain valid during the offer period, excluding variable market-driven prices. Price increases within three months due to law are allowed. Delivery outside the EU may incur import taxes, not included in the price. All prices are subject to typographical errors; the entrepreneur is not obliged to honor mistakes.

Article 10 – Conformity and Warranty
The entrepreneur guarantees products/services meet the contract, specifications, and legal requirements. Any defects or incorrect deliveries must be reported within 14 days. Warranty does not cover misuse, unauthorized repairs, or abnormal conditions.

Article 11 – Delivery and Execution
Orders are executed with due care, within 30 days unless agreed otherwise. Consumers will be informed of delays. Replacement items may be offered; return costs for replacements are borne by the entrepreneur. Risk transfers to the consumer upon delivery.

Article 12 – Ongoing Transactions: Duration, Termination, and Renewal
Consumers may terminate ongoing contracts at any time respecting agreed notice periods. Fixed-term contracts for regularly delivered products/services may not be silently renewed, except for short-term subscriptions as specified. Contracts over a year can be terminated after one year with one-month notice unless fairness dictates otherwise.

Article 13 – Payment
Amounts due must be paid within 7 days of the cooling-off period, unless agreed otherwise. Incorrect payment information must be reported immediately. In case of default, reasonable costs may be charged.

Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovering defects. The entrepreneur responds within 14 days or provides an estimated timeline for more complex complaints. If unresolved, disputes fall under the dispute resolution process. Valid complaints result in replacement or repair at no cost.

Article 15 – Disputes
Dutch law exclusively governs agreements between the entrepreneur and consumer, even if the consumer resides abroad.
